INSTANT WIN PRIZES

153 Instant Win Prizes: $1,000 scholarship/educational grants

(a) a scholarship/educational grant valued at $1,000.00 ("Instant Win Prize") to cover college or postsecondary vocational institution tuition, fees, books, supplies, equipment, related educational expenses and room and board to be awarded in the form of a check distributed to the school and located in the United States on behalf of the Winner or Winner’s designee; or

(b) a check for $1,000.00 to pay off student loans incurred by the winner in (a) above in the form of a co-payable check distributed to the lending institution on behalf of the Winner or Winner’s designee; or

(c) a combination of (a) and (b) above in an amount not to exceed $1,000.00.

SCHOLARSHIP AWARDS. All scholarship/educational prize awards (including Instant Win and Tournament Prizes below) will be administered and managed by Scholarship Management Services, a division of Scholarship America and are subject to the following and all other terms of these Official Rules.

Awards are to be used for postsecondary education and checks for the full amount will be sent to the institution designated by the Winners. Any unused funds at the conclusion of the students’ educational experience may be returned to the students to do with as he or she chose. Taxes on the portion of the award not used for educational purposes are the responsibility of the recipient.

Award amounts may be applied to educational loans.  Payments made for this purpose will be payable to the loan servicing company for the student.  (Award may be considered taxable and Form 1099-Miscellaneous Income will be issued.)

At the request of the recipient (i.e., the initial scholarship award winner), he/she may designate that the scholarship fund proceeds be held at Scholarship America on account for another person (designee) to be used for eligible education purposes as provided herein.  Upon notification as an initial winner, the initial winner must notify Scholarship America of his/her intent to gift the award proceeds to the designee.  Scholarship America will create an account for the designee and set aside the funds until such time as the designee notifies Scholarship America that he/she is ready to use the funds for eligible education-related expenses.  If the designee is under age 18, these funds may be held until the designee is 18. Once the designee reaches 18 or is already 18, these funds will be held until the designee reaches his or her 24th birthday . Any unused funds at the conclusion of this period may be returned to the students to do with as he or she chooses, however, taxes on the portion of the award not used for educational purposes are the responsibility of the recipient. The scholarship award proceeds shall be transferred one time only.  The initial scholarship award winner must supply the following identifying information about the designee:  name, address, phone number, date of birth, relationship and postsecondary school information (if known at such time).  Scholarship America shall not transfer the scholarship award proceeds to the designee until such time as the identifying information is verified by the designee and to the satisfaction of Scholarship America.  The initial scholarship award winner shall be responsible for completing and filing the required Gift Tax Forms with the Internal Revenue Service.

TOURNAMENT PRIZES
NOTE: YOU MUST HAVE ACCESS TO PLAY NCAA® FOOTBALL 10 ON XBOX LIVE.

(a) Four (4) Initial Tournament Tuition Prizes: a scholarship/educational grant valued at $1,000 to be used for the eligible expenses described in (a) of INSTANT WIN PRIZES above by competing in and winning a series of Four (4) college football gaming tournaments ("Football Gaming Tournament" or "Tournament") as more fully described below.

(b) Four (4) Added Value Initial Tournament Tuition Prize: a scholarship/educational grant to be used for the eligible expenses described in (a) INSTANT WIN PRIZES above.

In addition to the Tournament Tuition Prize of $1,000 in (a) TOURNAMENT PRIZES above, you can win an additional scholarship prize based on the number of additional Codes beyond your first Code, that you enter while participating in the Football Gaming Tournaments prior to winning such Initial Tournament, up to a maximum of 5 additional Codes and an additional $5,000.

  • $1,000 + (1 additional Code x $1,000) = $2,000
  • $1,000 + (2 additional Codes x $1,000) = $3,000
  • $1,000 + (3 additional Codes x $1,000) = $4,000
  • $1,000 + (4 additional Codes x $1,000) = $5,000
  • $1,000 + (5 additional Codes x $1,000) = $6,000

For example, if you enter up to 5 additional Codes while participating in the Football Gaming Tournaments prior to winning 1 of the 4 Initial Tournaments, then you multiply $1,000 by 5 to win an additional $5,000 for a total of $6,000 ($1,000 for the Initial Tournament Tuition Prize and $5,000 for the 5 additional Codes entered).

(c) One (1) Final Tournament Tuition Prize: a scholarship/educational grant valued at $5,000 to be used for the eligible expenses described in (a) INSTANT WIN PRIZES above by competing in and winning the Final Tournament as more fully described below.

d) One (1) Added Value Final Tournament Tuition Prize: a scholarship/educational grant to be used for the eligible expenses described in (a) INSTANT WIN PRIZES above.

In addition to the Final Tournament Tuition Prize of $5,000 in (c) TOURNAMENT PRIZES above, you can win an additional scholarship prize based on the number of additional Codes that you enter after winning 1 of the 4 Tournaments and prior to playing in the Final Tournament, up to a maximum of 5 additional Codes and an additional $25,000.

  • $5,000 + (1 additional Code x $5,000) = $10,000
  • $5,000 + (2 additional Codes x $5,000) = $15,000
  • $5,000 + (3 additional Codes x $5,000) = $20,000

Participating products are available at participating retailers during the Game Period. Not all brands and/or packages may be available in all markets. HOW TO REDEEM CODES

Go to the Website during the Game Period, and click on the $1,000-a-Day Football Game icon. If you are a current member of any Sponsor promotions or signed up for a previous promotion, fill in the appropriate login information, update your personal information (if necessary) or confirm that your personal information is correct. Otherwise, you will need to complete the promotional registration process by filling out the registration form including your actual name and residential address, (as they appear on your driver’s license or government identification), date of birth, email address, telephone and a unique password.

Enter your Code on the Website to determine if the Code is a winner of an Instant Win Prize. If you did not win an Instant Win Prize, you will receive a Dr Pepper Game Point that you can redeem immediately or at a later date to use your Code for entry into one the Football Tournaments as provided below in this Official Rules. Your Code will also earn you one entry into the 2009 Dr Pepper $123,000 Scholarship Promotion & Contest, provided that you meet the additional eligibility provisions described in the following paragraph and in such Promotion & Contest’s Official Rules.

ONLINE FOOTBALL GAMING TOURNAMENT: Codes can also be used to earn Dr Pepper Game Points that can be used to participate in a series of 4 Football Tournaments Ladders that will be conducted on the Tournament Website. To play the Tournaments, go to the Website, click on the $1,000-a-Day Football Game icon. Once you are on $1,000-a-Day Football Game webpage, click on the gamebattles.com icon. Once you are connected to gamebattles.com, login or register to set up an account on gamebattles.com. Then use your Dr Pepper Game Points to play 1 of the 4 Tournaments. The winner of each 1 of the 4 Ladders of the Football Gaming Tournaments will win an initial $1,000 Tournament Tuition Prize.

FINAL TOURNAMENT TUITION PRIZE: After the end of Ladder 4, the 4 winners from each Ladder will be entered into a final tournament ("Final Tournament"). The winner of the Final Tournament will be awarded a $5,000.00 Final Tournament Tuition Prize (in addition to any Instant Win Prize or Tuition Prize(s) won in prior Ladders).

2009 Dr Pepper $123,000 SCHOLARSHIP PROMOTION & CONTEST. Codes can also be used to enter the 2009 Dr Pepper $123,000 Scholarship Promotion & Contest, subject to its Official Rules. Note that in order to enter your Code in the 2009 Dr Pepper $123,000 Scholarship Promotion & Contest, you must be at least 18 years old but no older than 24, and must be registered or must register by the fall semester 2010 at a college, university or postsecondary vocational institution eligible under Title IV of the Higher Education Act of 1965 as amended and located in the United States, as a full time student (12 hours minimum) at time of participation. Winners must not be an active NCAA collegiate athlete (any division) in any sport. Entrants must also not have played professional, semi-professional, or Division I collegiate football at any time. PRIZE NOTIFICATION

After you have followed the instructions above, a message will appear on your screen to notify you that you have either won an Instant Win Prize (subject to verification, award process and these Official Rules) or have not won an Instant Win Prize. If you have won an Instant Win Prize, you may also be notified by email, phone and/or mail. If you do not claim your Instant Win Prize by the Prize Claim Deadline, the prize will be forfeited. Winners of all prizes may be required to sign an affidavit of eligibility and release of publicity/liability ("Affidavit") within the time period specified by Sponsor or Administrator in the letter accompanying the Affidavit ("Prize Letter") or prize will be forfeited. If mail is returned as undeliverable without a forwarding address, then prize may be forfeited. An alternate winner for forfeited prizes may be selected at Sponsor’s sole discretion. Prize will be awarded upon receipt of Affidavit, and verification of prize winner. Any required Affidavits or other documents must be signed by parent/legal guardian of a minor in his/her state of residence.

CONTESTENT WINNERS RIGHTS OF USAGE

Sponsor reserves the right to document and track how scholarship funds are being used and require the winners to notify Sponsor of any changes to their contact information provided at registration on the Website (i.e., name, residential address, phone number and email address) up through December 31, 2024. Additionally, Winners will be invited to attend future college championship games (game to be selected at Sponsor’s sole discretion). By accepting a prize, you agree to notify Sponsor of any changes to your contact information, provide updated information to Sponsor describing how the prize is being used. Furthermore, you understand that you may be invited to attend upcoming college championship games. Sponsor agrees to give you a prize package covering transportation, tickets to the game, and meals for you and one (1) guest. You agree to make a good faith effort to attend future college championship games when and if invited by Sponsor.

LIMIT ON CODES: 10 Codes per day.

LIMIT ON PRIZES: Other than a winner winning one Instant Win Prize, one of the Tuition Tournament Prizes, and the Final Tournament in this Football Game, there is a limit of one other prize (valued at $600 or more) allowed per person/household per 12 consecutive month period in any promotion sponsored by Sponsor or any of its affiliated companies.

Odds for the Instant Win Prize are based on the total codes entered during the Game Period.

"RELEASEES" MEANS SPONSOR, ALL GAME PARTIES, GAME PROVIDERS AND ALL OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, SHAREHOLDERS, DIRECTORS AND AGENTS.

LIMITATIONS: Neither Sponsor nor any other Releasee is responsible for: lost, late, damaged, incomplete, illegible, stolen, misdirected, or postage due mail, shipping or email; any website, computer, telephone, satellite, cable, network, Internet or other equipment, electronics, software, service, transmission, connection, processing or other errors, failures, congestion, accessibility or availability issues; unauthorized access, tampering, hacking, theft or destruction; or other technical or human error in the receipt or processing of entries, game piece requests or other submissions (whether to or from) or otherwise related to the production, promotion, administration or execution of the Game.

TAMPERING/VIOLATIONS/DISRUPTION: Sponsor may, in its sole determination, disqualify any person it believes may be tampering with the entry or other operation of the Game or acting in violation of the Official Rules, in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.

CANCELLATION/MODIFICATION: Sponsor may, in its sole discretion, cancel, terminate, modify or suspend the Game if the Game is not capable of running as Sponsor planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Game).

EMAIL ACCOUNT HOLDER: If the holder of an email account is disputed, entry will be deemed made by the natural person who is assigned to the e-mail address by the internet access provider, online service provider or other organization (e.g., business, school, etc.) that assigns e-mail addresses for the domain associated with the e-mail address.

NO PRIZE WARRANTY: WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS. SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.

DISPUTES: GAME IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS. IF NOT RESOLVED THROUGH DIRECT DISCUSSIONS, ANY CLAIM SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION WITH AN EXPERIENCED ARBITRATOR LICENSED TO PRACTICE LAW IN TEXAS. FORUM AND VENUE FOR ANY ARBITRATION PROCEEDINGS WILL BE IN COLLIN COUNTY, TEXAS. Requests must be received by the Free Code Request Deadline. Each mail-in request must be mailed separately. No mechanical reproductions permitted. Free Codes will be emailed.

HOW TO REDEEM CODES
Go to the Website during the Promotion Period, and click on the $123,000 Scholarship Promotion Icon. If you are a current member of any Sponsor promotions or signed up for a previous promotion, fill in the appropriate login information, update your personal information (if necessary) or confirm that your personal information is correct. Otherwise, you will need to complete the promotional registration process by filling out the registration form including your actual name and residential address, (as they appear on your driver’s license or government identification), date of birth, email address, telephone and a unique password.
From the landing page, indicate that you would like to participate in the $123,000 Scholarship Promotion by clicking on the Dr Pepper Scholarship Icon.
When you are on the landing page of the Website, the first time you enter a Code, if you are within the Age Eligibility, your entry will automatically generate a pop up window with a message inviting you to enter the $123,000 Scholarship Promotion. From the landing page, indicate that you would like to participate in the $123,000 Scholarship Promotion by clicking on the Dr Pepper $123,000 Scholarship Icon.
You will be asked to confirm that you meet the age, academic, athletic and other eligibility conditions (see Eligibility), accept the Terms & Conditions and the Official Rules. You will then be asked to submit an optional essay. Upon the next step of either submitting an essay or choosing not to submit an essay, you will automatically be entered once in the $123,000 Scholarship Promotion.
ADDITIONAL ENTRIES
After registering for the $123,000 Scholarship Promotion, all subsequent Codes entered will gain an additional entry into the $123,000 Scholarship Promotion and a chance to win a prize in the $123,000 Scholarship Promotion. Additional Code entries into the $123,000 Scholarship Promotion will begin the day that you click on the Dr Pepper $123,000 Scholarship Icon and accept the Terms & Conditions and the Official Rules. THE DRAWING: Winners will be selected by random electronic drawing on or about Drawing Date by Administrator.

PRIZE NOTIFICATION
Winners will be notified by email and phone within 48 hours of the drawing. If after a reasonable number of attempts during a day (as determined by Sponsor or Administrator in its sole discretion) contact is not made with winner, prize will be forfeited and an alternate winner selected. Winner may be required to sign an affidavit of eligibility and release of publicity/liability ("Affidavit") within the time period specified by Sponsor or Administrator in the letter accompanying the Affidavit ("Prize Letter") or prize will be forfeited. If mail is returned as undeliverable without a forwarding address, then prize may be forfeited. Please note that you are not a winner until your eligibility has been verified and you have fully complied with the Official Rules. An alternate winner for forfeited prizes may be selected at Sponsor’s sole discretion. Prize will be awarded upon receipt of Affidavit, and verification of prize winner. Any required Affidavits or other documents must be signed by parent/legal guardian of a minor in his/her state of residence. 1. 3 $123,000 Scholarship Prizes (One at each Grand Prize Game): One Hundred Twenty-Three Thousand and No/100 Dollars ($123,000) Scholarship, payable as follows:
(a) a $123,000.00 scholarship to cover up to college or postsecondary vocational institution tuition, fees, books, supplies, equipment, related educational expenses and room and board to be awarded in the form of a check disbursed to the school (eligible under Title IV of the Higher Education Act of 1965 as amended) and located in the United States on behalf of the Winner; or
(b) $123,000 to pay off student loans incurred by the Winner for eligible costs in (a) above in the form of a check distributed to the lending institution on behalf of the Winner; or
(c) a combination of (a) and (b) above in an amount not to exceed $123,000.00.

2. 3 Consolation Prizes (One per Grand Prize Game): Twenty-Three Thousand and No/100 Dollars ($23,000.00) Scholarship, payable as follows:

SCHOLARSHIP AWARDS. All scholarship/educational prize awards (including Instant Win and Tournament Prizes below) will be administered and managed by Scholarship Management Services, a division of Scholarship America and are subject to the following and all other terms of these Official Rules.

Awards are to be used for postsecondary education and checks for the full amount will be sent to the institution designated by the Winners. Any unused funds at the conclusion of the students’ educational experience may be returned to the students to do with as he or she chooses. Taxes on the portion of the award not used for educational purposes are the responsibility of the recipient. Taxes on the portion of the award not used for educational purposes are the responsibility of the Winners. Taxes on the value of the trip portion of the prize are the responsibility of the Winners. Winners will receive a form 1099 for the value of the trip package.

Award amounts may be applied to educational loans.  Payments made for this purpose will be payable to the loan servicing company for the student.  (Award may be considered taxable and Form 1099-Miscellaneous Income will be issued.)

The choice between the Big 12 Game Site, SEC Game Site, or ACC Game Site is at the sole discretion of the Sponsor. Trip includes round trip coach air transportation for two from the major U.S. airport nearest the Pass Contestant’s/Alternate’s home to Arlington, TX, Atlanta, GA or Tampa, FL (as applicable), three nights (standard, double occupancy) lodging, airport transfers, commemorative gifts (which shall be solely determined by Sponsor), admission to pre-game Sponsor party, and 2 tickets to the Grand Prize Game, and the Grand Prize Winner will have a chance to compete as a Pass Contestant as described in these Rules. Guest of Winners must return their signed affidavit/release at the same time as Winner. Guest must travel together with Winner on same itinerary, and shall be required (or, if a minor, his/her parent/legal guardian shall be required) to sign and return a release of liability/publicity prior to issuance of travel documents. Minors traveling with Winner must be accompanied by their parent or legal guardian. Travel arrangements shall be through Sponsor’s agent, on a carrier of Sponsor’s choice. Certain restrictions/blackout dates may apply, and travel is subject to applicable provider’s terms and conditions. Winners are responsible for all other travel expenses not specifically listed herein as being awarded. Trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. Winners shall be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (collectively, "Affidavit") within 5 days of issuance or the prize will be forfeited. Approximate retail value may vary based on location of winner’s residence.) All other expenses, not specifically mentioned herein, including taxes, transportation to/from the airport are the sole responsibility of the Grand Prize/First Prize winner.

Entrants acknowledge that the prize and its value are trip, tickets and only the chance to compete as described herein. The value of the chance to compete and the odds of winning the competition are dependent on a multitude of factors and cannot be determined with any degree of certainty and no odds or value on such aspect of the $123,000 Scholarship Promotion shall be ascribed to such portion.
CONTESTENT WINNERS RIGHTS OF USAGE
Sponsor reserves the right to document and track how scholarship funds are being used and require the winners to notify Sponsor of any changes to their contact information provided at registration on the Website (i.e., name, residential address, phone number and email address) up through December 31, 2024. Additionally, Winners may be invited to attend future college championship games (game to be selected at Sponsor’s sole discretion). By accepting a prize, you agree to notify Sponsor of any changes to your contact information, provide updated information to Sponsor describing how the tuition portion of the prize is being used. Furthermore, you understand that you may be invited to attend upcoming college championship games. If you are invited to an upcoming college championship game, Sponsor agrees to give you a prize package covering transportation, tickets to the game, and meals for you and one (1) guest. You agree to make a good faith effort to attend future college championship games when and if invited by Sponsor.
HALFTIME EVENT
On Saturday, December 5, 2009, during half-time at each of the 3 Grand Prize Games, (each a "Halftime Event") the Pass Contestants (2 per game) will each have the opportunity to pass 10 footballs provided by Sponsor within 45 seconds from the 5-yard line into a 2’ diameter "target" hole ("Target") cut into 2 oversized Dr Pepper can replicas (1 can replica for each Pass Contestant) provided by Sponsor which will be located on the goal line nearest the Pass Contestants ("Can Replica"). Pass Contestants may not wear gloves or use any throwing aid. No warm up or trial passes will be permitted by the Pass Contestants. The Pass Contestants will have a total of 45 seconds to complete the most passes. Passes must pass from Pass Contestants’ hand, fully through the Target in the Can Replica, without touching the ground or any object or surface other than the Can Replica, all as solely determined by Sponsor or its judges, in order to be considered a "Successful Pass". The Pass Contestant who throws the most Successful Passes will win the $123,000 Scholarship Prize as outlined in the Grand Prize description above (one $123,000 Scholarship Prize winner for each Grand Prize Game) ("Winner"). The runner up for each Grand Prize Game will win the Consolation Prize described above.
CONTESTANT TIE-BREAKER
On Saturday, December 5, 2009 after the Halftime Event pass competition is completed, if there is a tie between the Pass Contestants, then a tie-breaker throw-off will be conducted. Each Pass Contestant will have the opportunity to pass 5 additional footballs provided by Sponsor within 45 seconds from the 5-yard line into the Target in the Can Replica provided by Sponsor which will be located on the goal line nearest the Pass Contestants. The Pass Contestant who throws the most Successful Passes in such tie-breaker will win the $123,000.00 Scholarship Prize described above (1- $123,000 Scholarship Prize winner for each in such tie-breaker Grand Prize Game) ("Winner"). The runner up for each Grand Prize Game will win the $23,000 Consolation Prize described above. In the event a tie still remains after the second round of competition the final tiebreaker will be determined based upon the results of a preliminary tie-breaker conducted on Friday, December 4, 2009 where the 2 Pass Contestants at each of the 3 Grand Prize Games will compete to determine which Pass Contestant would be declared the Winner. In the preliminary tie-breaker, the Pass Contestants will participate in a competition in which each Pass Contestant will each have the opportunity to pass 10 footballs provided by Sponsor within 30 seconds from the 5-yard line into the Target cut into 2 Can Replicas (1 Can Replica for each Pass Contestant) provided by Sponsor which will be located on the goal line nearest the Pass Contestants. The preliminary tie-breaker will take place in the Big 12 Game Site, SEC Game Site and ACC Game Site. Pass Contestants may not wear gloves or use any throwing aid. Passes must pass from Pass Contestant’s hand fully through the Target, without touching the ground or any object or surface in order to continue in competition, all as solely determined by Sponsor or its judges. If there is a tie, this process will be repeated until there is a Pass Contestant preliminary tie-breaker winner.
GENERAL COMPETITION/ HALFTIME EVENT RULES
If any Pass Contestant or Alternate is not at the Sponsor’s designated Pass Contestant/Alternate meeting at dates, times, and locations specified, he/she will be disqualified. Pass Contestants and Alternates must use soft-soled shoes only (no metal cleats), and must attempt all passes without gloves or any throwing aid or any third party assistance of any kind. All of Sponsor’s and/or its judges’ decisions regarding positioning of Pass Contestants and Alternates, timing of throws, and other details of Pass Competition, Half-Time Event, Contestant Tie-Breaker, and $123,000 Scholarship Event shall be final. Locations, dates and times may be subject to change.

LIMIT ON PRIZES: Limit of 1 prize (valued at $600 or more) allowed per person/household per 12 consecutive month period in any promotion sponsored by Sponsor or any of its affiliated companies.

Odds are based on the total codes entered and the number of eligible entries received during the Promotion Period.

THE FOLLOWING TERMS AND CONDITIONS APPLY TO THE SCHOLARSHIP PROMOTION AND ARE PART OF THE FULL OFFICIAL RULES.

GENERAL CONDITIONS: By participating, you accept and agree to abide by the Official Rules and all decisions of Sponsor and its judging and administration organizations, which are final and legally binding in all respects. No substitution or transfer to a third party of all or any part of prize permitted. If, for any reason, a prize cannot be awarded or winner is not capable of redeeming a prize, Sponsor is not obligated to award it and Sponsor reserves the right, in its sole discretion, whether or not to substitute the prize (or portion of prize) with a prize of comparable or greater value or cash value. Sponsor further reserves the right for any reason, in its sole discretion, to award the cash value of a prize in lieu of awarding the stated prize. If, for any reason, more prizes are available or claimed than the stated number, Sponsor reserves the right to randomly draw winners from eligible prize claimants in such prize category. Winners are solely responsible for all federal, state and local taxes if any, on prizes and any expenses not specifically awarded in the Official Rules. Non-compliance with these Official Rules may result in disqualification. You are not a winner unless and until (A) you have fully complied with the Official Rules and (B) all verification and award processes have been completed. Acceptance of prize constitutes permission for Sponsor and its designees to use winner’s name and/or likeness for purposes of advertising and promotion in any medium, without further compensation, except as prohibited by law.

RELEASE OF LIABILITY: BY ENTERING THE SCHOLARSHIP PROMOTION, YOU HEREBY AGREE THAT IN NO EVENT WILL SPONSOR OR ANY OTHER RELEASEE BE RESPONSIBLE OR LIABLE FOR, AND YOU HEREBY RELEASE THEM FROM, ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LOSSES, COSTS, EXPENSE OR LIABILITY OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PERSONAL INJURIES AND/OR DEATH, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND COUNSEL FEES AND COURT COSTS) ARISING OR RESULTING FROM ANYTHING RELATING TO:

THE PRODUCTION, PROMOTION, ADMINISTRATION OR EXECUTION OF THE SCHOLARSHIP PROMOTION (OR YOUR PARTICIPATION IN IT); CANCELLATION, MODIFICATION OR RESCHEDULING OF ANY ASPECT OF THE SCHOLARSHIP PROMOTION; USE OF ANY WEB SITE(S) RELATED TO THE SCHOLARSHIP PROMOTION OR MATERIALS ON THE WEB SITE; ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THE PRIZE; OR PARTICIPATING IN OR TRAVELING TO ANY SCHOLARSHIP PROMOTION-RELATED ACTIVITY.

"RELEASEES" MEANS SPONSOR, ALL SCHOLARSHIP PROMOTION PARTIES, SCHOLARSHIP PROMOTION PROVIDERS AND ALL OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, SHAREHOLDERS, DIRECTORS AND AGENTS.

LIMITATIONS: Neither Sponsor nor any other Releasee is responsible for:
lost, late, damaged, incomplete, illegible, stolen, misdirected, or postage due mail, shipping or email;
any website, computer, telephone, satellite, cable, network, Internet or other equipment, electronics, software, service, transmission, connection, processing or other errors, failures, congestion, accessibility or availability issues;
unauthorized access, tampering, hacking, theft or destruction; or
other technical or human error in the receipt or processing of entries, game piece requests or other submissions (whether to or from) or otherwise related to the production, promotion, administration or execution of the Scholarship Promotion.

TAMPERING/VIOLATIONS/DISRUPTION: Sponsor may, in its sole determination, disqualify any person it believes may be tampering with the entry or other operation of the Scholarship Promotion or acting in violation of the Official Rules, in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SCHOLARSHIP PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.

CANCELLATION/MODIFICATION: Sponsor may, in its sole discretion, cancel, terminate, modify or suspend the Scholarship Promotion if the Scholarship Promotion is not capable of running as Sponsor planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Scholarship Promotion).

EMAIL ACCOUNT HOLDER: If the holder of an email account is disputed, entry will be deemed made by the natural person who is assigned to the e-mail address by the internet access provider, online service provider or other organization (e.g., business, school, etc.) that assigns e-mail addresses for the domain associated with the e-mail address.

NO PRIZE WARRANTY: WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS. SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.

DISPUTES: SCHOLARSHIP PROMOTION IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS. IF NOT RESOLVED THROUGH DIRECT DISCUSSIONS, ANY CLAIM SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION WITH AN EXPERIENCED ARBITRATOR LICENSED TO PRACTICE LAW IN TEXAS. FORUM AND VENUE FOR ANY ARBITRATION PROCEEDINGS WILL BE IN COLLIN COUNTY, TEXAS. THE REMEDY FOR ANY CLAIM SHALL BE SUBJECT TO ALL LIMITATIONS AND RELEASES SET FORTH IN THESE RULES, BE LIMITED TO ACTUAL OUT OF POCKET DAMAGES, AND SHALL NOT, IN ANY EVENT, INCLUDE ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, ATTORNEY'S FEES OR COSTS OF BRINGING A CLAIM, OR ANY INJUNCTIVE OR OTHER EQUITABLE RELIEF.
